The Platform is available for Users that have the full legal capacity in accordance with the law (If an individual, your age shall be at least 18 years old and if an entity you shall be legally established in accordance with the laws of your country, you have the documentation required to proof the same, and you are authorized to accept these Terms on behalf of your entity). Your access and use of the Platform shall be for personal use only and shall be subject to the laws of the Kingdom of Saudi Arabia (In addition to these Terms).

• Be at least 18 years of age or have the necessary legal capacity.
• Ensure that all information provided is accurate, complete, and up to date.
• Use the platform in compliance with all applicable laws and regulations.

• All content available on the Platform, which includes – without limitation – information, materials, software, photographs, graphics, video, documents, text, data, and any other type of content, is the exclusive property of the Foundation or its licensors.
• By accessing or using the Platform, whether as a registered user or not, you hereby undertake NOT to and refrain from:
• Selling, licensing, renting, modifying, copying, reproducing, reprinting, downloading advertising, transferring, distributing, displaying in public, editing, or using the content to produce works for public or for commercial purposes, unless otherwise specified.
• Using the platform to send commercial, unsolicited, or spam emails, or for any form of misuse.
• Publishing, advertising, distributing any content that is defamatory, illegal, violates public morals and Islamic teaching, or breaches any applicable laws and regulations.
• Using a software, scripts, or any other content or means that interfere with or attempt to disrupt the Platform's normal operation, including uploading or downloading any files containing viruses, corrupted data, or any other malicious software, or do anything that could affect the continues availability of the information on the Platform.
• Avoid taking any action that places an excessive or unreasonable load on the Platform’s infrastructure or intercept or attempt to intercept the proper operations of the Platform.
• Uploading or downloading files containing software, data, or materials that is not owned by you or for which you do not have a license.
• Take any action that violates the Saudi Anti-Cyber Crime Law or any other related laws and regulations.

• The use of additional features in the Platform requires registering for a user account. Mainly, Grant Application, which allows users to apply for grants provided by the Foundation, and Personalized Notification, which provides updates and publications relevant to the User’s interests.
• When registering for an account, you shall ensure the following:
• Users must provide accurate, complete, and up-to-date information during registration.
• Users are responsible for maintaining the confidentiality of their account credentials and must not share their login details with others, or allow any third party to use your user credentials. You shall be solely responsible for any use of your account whether it was by your knowledge or not.
• If you suspect unauthorized use of your account or credentials or any other breach of security, you shall notify us immediately.
• You may not sell or otherwise transfer your account to others.
• You shall not create more than one account.
• We reserve the right to suspend or terminate any account for any reasons at any time under out sole discretion, including accounts that violates these Terms.

• Submitting a grant application does not guarantee receiving the grant; decisions are made at the Foundation’s sole discretion.
• The application submitted shall include all required information and documents as noted in the Platform or communicated by us. You must ensure that all information and documents provided by you are truthful, complete, accurate and do not violate or attempt to violate any third party’s right.
• Should your application be accepted, the provision of the grant shall be subject to you signing an agreement with the Foundation that includes the detailed and additional terms and conditions for the grant provided (the “Grant Agreement”).
• Any misuse of the grant, misrepresentation of information, or violation of these Terms or the Grant Agreement may result in the revocation of the grant, termination of the Grant Agreement, legal consequences, and /or ineligibility to apply for future grants.

User data is collected, processed, and stored in accordance with the Saudi Personal Data Protection Law (PDPL) and our Privacy Policy, available in the Platform. By using the Platform, you consent to the collection and processing of your personal data in accordance with our Privacy Policy.

We reserve the right to:

• Deny, suspend or terminate access or accounts for any reason at any time under our sole discretion and without prior notice, including reasons relevant to the violations of these Terms.
• Restrict access to grant applications or notifications for any reason at any time under our sole discretion and without prior notice .
• Remove any submitted content that does not align with the Platform guidelines.
• We reserve the right to suspend or terminate the Platform and/or these Terms at any time under our sole discretion and without a notice, including the temporary suspension required to maintain, develop or modify the Platform.
• In case of terminating these Terms or access to the Platform or the account, sections (5 – Data Privacy and Usage), (7 – Governing Law and Dispute Resolution), (8 – Indemnity) shall survive the termination.

• These Terms of Use shall be governed by the laws and regulations enforced in the Kingdom of Saudi Arabia (the “Applicable Law”).
• Any disputes arising under these Terms of Use shall first be resolved through negotiation. If unresolved within (30) days from starting the negotiations, the disputes shall be subject to the jurisdiction of the competent courts in Saudi Arabia.

To the extent permitted by the Applicable Law, you hereby agree to cooperate, defend, hold harmless, and indemnify the Foundation and its officers, employees, agents, partners, suppliers, affiliates, licensors, and service providers from and against any and all claims, suits, proceedings, losses, liabilities, and expenses (including attorney’s fees and costs), whether in tort, contract, or otherwise, relating to or arising from:

• your use and/or registration on the Platform and using the content or information available in the platform.
• activities occurring under your account.
• violation of these Terms, the Privacy Policy or the Grant Agreement (if executed).
• violation of any third party’s right.
• any breach of the Applicable Law.

• We reserve the right to update these Terms at any time. Any modifications will be effective upon posting the updated Terms on the Platform.
• Users are encouraged to review these Terms periodically to stay informed of any changes.

• If any provision of these Terms is held by a competent authority as illegal, invalid, or unenforceable, the Foundation shall reserve the right to alter the provision in a way that makes such provision valid or delete the provision. This invalidity shall not affect the remaining provisions of these Terms, and it shall remain in full force and effect.
• The use of words like including, for example, and without limitation shall mean that the information provided in the relevant provision is not exhaustive but rather illustrative.
• The Foundation might assign these Terms at any time without notice or approval from you. On the contrary, you may not transfer or assign these Terms.
• These Terms, the Privacy Policy, and the Grant Agreement (if executed) shall supersede all prior or contemporaneous representations, understandings, agreements, or communications between you and us, whether written or verbal, regarding it subject matter.
